Indigenous Peoples' tenure rights

Definition

  • Information Indigenous Peoples’ tenure rights are the rights that Indigenous Peoples traditionally have over land, fisheries and forests to occupy, use, develop, enjoy and withdraw benefits from the natural resources, as well as the right to restrict others’ access to these resources; and/or the right to manage, sell or bequeath the resources.

    Created: 12/2/22

Scope note

  • It is important to highlight the difference between the rights themselves and the tenure rights which have to do with the way Indigenous Peoples traditionally hold and manage their lands, territories. Indigenous peoples tenure rights are understood within their collective rights. Their customary rights often refer to the management of communal areas and resources.
